1. Acceptance of Terms
By downloading, installing, or using the TimeCounts application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
TimeCounts is a calendar-native event timing application that provides event timers, calendar sync, timer creation, cross-device synchronization, and related features. The service is provided by TimeCounts LTD, a company registered in England (Company #16008575).
3. User Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.
4. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to: (a) use the App in any way that violates applicable law; (b) attempt to gain unauthorized access to the App or its systems; (c) interfere with or disrupt the integrity of the App; (d) use the App to transmit any harmful code or content.
5. Intellectual Property
The App and its original content, features, and functionality are owned by TimeCounts LTD and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the App without our express written permission.
6. User Data
You retain ownership of the data you create within the App (timers, events, calendar sync data, presets). We store and process this data in accordance with our Privacy Policy. You grant us a limited license to use your data solely for the purpose of providing and improving the service.
7. Service Availability
We strive to maintain high availability of the App and its synchronization services. However, we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that temporarily affect availability.
8. Limitation of Liability
To the maximum extent permitted by law, TimeCounts LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months prior to the claim.
9. Termination
We may terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time through the App settings or by contacting support.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
